What Happens When My Court Orders Are Not Followed?

Contempt of court is one of many remedies that Missouri courts use to enforce their family law orders. When your court orders are not followed, it is possible to force the other party to pay monetary fines or even to be imprisoned until payment is made.

Our St. Louis contempt of court lawyers understand the laws of Missouri and will work to protect your rights in court. The court will look to certain factors when determining if contempt has in fact occurred:

  • If there was an actual violation of a court order
  • Whether the violator was able to conform to the order
  • Whether the violator intentionally placed himself or herself in a position to not be able to comply with the order

Denying Visitation and the Consequences

Contempt of court actions may also be filed if custody orders and/or visitation is being denied improperly. There is no rule that says a court must find a party in contempt for violating visitation, but the court may use its discretion depending on the circumstances.

At our Clayton family law firm, we will work with you to build a solid contempt of court case that fully explains your situation to the court.
